Negotiation And Preparation Of Contracts

We advise corporate and individuals on various contracts.  Central to this service is the negotiation and preparation of various Contracts in various spheres of commercial law such as the acquisition/disposal of residential, commercial and industrial properties through outright sales, Share Transfer Agreements and Cessions. Our expertise in this field also encompasses Contract Farming Agreements, Lease Agreements in respect of commercial, residential and industrial premises and Tributary Agreements and mining concessions.

We also prepare Loan Agreements and Acknowledgements of Debt.

Debt Recovery

We engage in Debt Recovery on behalf of corporate and individuals. In this regard, we employ innovative and cost-effective strategies tailored to ensure that the exercise would not be a case of “good money chasing after bad money”. In most circumstances, our charges are results-based; we charge an agreed rate of collection commission on the amounts actually collected while our clients are required to meet some disbursements. Generally our fee regime is structured in a manner that ensures reasonable business to us for services delivered to our client’s satisfaction at reasonable cost that makes debt collection a worthwhile exercise.

On behalf of our corporate and individual clients, we attend to registration, with Deeds office, of Transfers of residential, commercial and industrial properties. The registrations are done either independently or simultaneously with bond registrations passed in favour of various banks, building societies and financial institutions. We are the conveyance for Bloomingdale Development Company and have passed over 500 transfers in their development.

Our charges for services in this regard are levied in terms of the Law Society Conveyancing Tariff.

Registrations Of Mortgage Bonds

We attend to registration of mortgage bonds in favour of banks, buildings societies and financial institutions. The registrations are done either independently simultaneously with registration of transfers of residential, commercial and industrial properties.

We have extensive experience in this field having advised Bloomingdale Development Company on its project in the western area of Harare consisting of at least 500 units. We worked on the project from its inception up to the registration of transfer of individual units. From this and other related projects, we have developed an organic understanding and appreciation of the requisites of a successful Real Estate project. That has naturally enhanced our expertise in regard to how to legally extract value from land by way of subdivisions, consolidations and Property Development. Our innovative service, the Diaspora Building Management and Building Funds Disbursement has been specifically designed for Diasporans who would like to invest in building in Zimbabwe. We have observed that a lot of diaspora investors struggle with construction of their properties in Zimbabwe. Our experience with Bloomingdale a larger housing estate in Harare where we were the transfer attorneys confirmed this observation. The challenges diasporans experience ranged from relatives entrusted with the building, stealing, misappropriation of building funds, procurement and usage of substandard materials and diversion of some portion of the funds for their own use. In a few cases, diasporans would be sent pictures of houses being constructed which did not even belong to them. Our innovative service, therefore, ensures that investors in the diaspora who would like to build in Zimbabwe, have peace of mind, knowing that their projects would be managed properly, professionally and that their funds will be used for the purposes they are meant for.
